Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Picky AI mobile application and related services (collectively, the “Service”) operated by The Good Tayeb FZ-LLC (“Picky,” “we,” “our,” or “us”), a company incorporated under the laws of the United Arab Emirates, Meydan Free Zone.

By downloading, accessing, or using Picky, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

  • You must be at least 13 years old to use Picky.
  • If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use Picky with the consent of a parent or legal guardian.
  • By using Picky, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To use certain features of Picky, you may need to create an account. You agree to provide accurate and complete information during registration and to keep your account credentials confidential. You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

3. Description of Service

Picky is an AI-powered photo intelligence platform that helps you choose your best photos. The Service includes:

  • AI Photo Analysis: Upload photos to receive instant AI-generated scores, feedback, and suggestions powered by Google's Gemini API.
  • Social Voting: Create anonymous voting links to share with friends, followers, or communities to collect opinions on your photos.
  • AI Photo Editing: Access AI-powered editing tools to enhance your photos (subject to usage limits based on your plan).
  • Analytics: View detailed voting results, trends, and insights (available features may vary by plan).

Picky continuously evolves. We may add, modify, or discontinue features at any time with or without notice.

4. User Content

4.1 Your Content

You retain ownership of all photos, images, and other content you upload to Picky (“User Content”). By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your content solely for the purpose of providing and improving the Service.

4.2 Content Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to all User Content you upload.
  • Your User Content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights.
  • Your User Content does not contain illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable material.

4.3 Voting Content

When you create a voting link, your photos may be displayed to anyone with access to that link. Voting is anonymous — voters are not required to create accounts. You are solely responsible for where and how you share your voting links.

5. Prohibited Uses

You agree not to use Picky to:

  • Upload content depicting minors in any inappropriate, suggestive, or exploitative context.
  • Upload content that is sexually explicit, pornographic, or obscene.
  • Harass, bully, stalk, or intimidate any individual.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload content that promotes violence, hate speech, discrimination, or illegal activity.
  • Attempt to reverse engineer, decompile, or extract source code from the Service.
  • Use automated systems (bots, scrapers, etc.) to access or interact with the Service without our written consent.
  • Manipulate voting results through fraudulent means, including creating fake votes or using bots.
  • Circumvent any usage limits, paywalls, or access restrictions.

We reserve the right to remove any content and suspend or terminate any account that violates these prohibitions, at our sole discretion and without prior notice.

6. Subscriptions, Payments & Refunds

6.1 Free & Paid Features

Picky offers both free and paid features. Free features include basic AI photo analysis and sharing voting links with a limited number of voters. Paid features include detailed analytics, extended AI editing, and expanded voting capabilities.

6.2 In-App Purchases

Picky offers the following paid options, which may change from time to time:

  • Pay-Per-Link Unlock: A one-time purchase to unlock detailed analytics for a specific voting link.
  • Monthly Subscription: An auto-renewable subscription providing ongoing access to premium features, billed monthly.
  • Annual Subscription: An auto-renewable subscription providing ongoing access to premium features, billed annually at a discounted rate.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

6.4 Managing Subscriptions

You can manage or cancel your subscriptions at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial subscription periods.

6.5 Refunds

All purchases are processed through Apple's App Store. Refund requests are subject to Apple's refund policies. To request a refund, please contact Apple Support directly through the App Store.

6.6 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following the date of the change. We will provide you with reasonable notice of any price changes.

7. AI-Powered Features

7.1 Third-Party AI

Picky uses Google's Gemini API to power AI photo analysis and editing features. When you use these features, your photos and related prompts are sent to Google's servers for processing. We use the paid API tier, meaning your data is not used by Google to train their general models. Google's API Terms of Service apply to this processing.

7.2 AI Limitations

AI-generated scores, feedback, and editing suggestions are provided for informational and entertainment purposes only. AI outputs may be inaccurate, biased, or inappropriate. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You should exercise your own judgment when relying on AI outputs.

7.3 No Guarantee of Availability

AI features depend on third-party services and may be temporarily unavailable due to outages, maintenance, or changes to third-party APIs. We are not liable for any interruption or degradation of AI-powered features.

8. Intellectual Property

The Service, including its design, branding, software, AI models (excluding third-party models), and all other intellectual property, is owned by The Good Tayeb FZ-LLC and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

9. Privacy

Your use of Picky is also governed by our Privacy Policy, available at usepicky.com/privacy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

10. Data Deletion & Account Termination

You may request deletion of your account and associated data at any time by contacting us at thegoodtayeb23@gmail.com. Upon receiving a verified deletion request, we will delete your personal data within 30 days, except where retention is required by law. Deletion of your account is permanent and cannot be undone.

Please note that photos shared through voting links may have been viewed by voters prior to deletion. We cannot retroactively remove content that has already been accessed by third parties through shared links.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy or reliability of any AI-generated content.

12. Limitation of Liability

To the maximum extent permitted by applicable law, The Good Tayeb FZ-LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless The Good Tayeb FZ-LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to and finally resolved by the courts of Dubai, United Arab Emirates.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by other reasonable means. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and The Good Tayeb FZ-LLC regarding the Service, and supersede all prior agreements, understandings, or representations.
